Is there anyone here that thinks a DN or BEV Mole won't pay to access those sites that charge? I would say there is a better chance of getting busted because they are profiting off the bins. The folks in the states that have been busted are the ones that sell and charge fees to load the bins. I think it was about a year and a half ago, if memory serves me right (I wouldn't bet on that), some sheriff Deputies were busted and what they charged them with is just that. They were charging $50 each time they loaded up customers they sold FTA recievers to. About 9 months ago a guy was charging for loading folks boxes with bins at their house and he had hundreds of customers. He got busted. Even though the FCC in the states says we have as much right to recieve as they do to transmit anyone can file a lawsuit. DTV filed tons of them in the card days. Most settled because we the public don't have as deep pockets as the providers. I say horse sh!t on all of them. If they wanted to stop the the bins they can spend the bucks and have motorola setup the encryption. THe 4DTV recievers they designed for C-band to this day have not been cracked...... |

Undoubtedly the move comes as a response to its current legal battle with FTA receiver distributor Viewtech. This week, EchoStar asked that a federal judge in San Diego throw out Viewtech's request to have the satellite company's lawsuit against it dismissed. EchoStar's suit, filed earlier this year, claims Viewtech knowingly designs, manufactures and distributes FTA receivers to purposely allow users to steal DISH Network TV service - a violation of the Digital Millennium Copyright Act. EchoStar said Viewtech developed software that users can download that transforms the otherwise legal receivers into signal piracy tools. In Viewtech's request to have the original lawsuit thrown out, the technology firm claimed EchoStar does not own the copyrights to the programming DISH Network distributes. EchoStar asked the court to reject that notion as well. In other EchoStar legal news, the satellite company added more names to its list of end users it has sued for allegedly pirating DISH Network's signals. The company filed a lawsuit against Florida resident Miguel Garcia and two Illinois residents Andrew and Beth McSkimming alleging the unauthorized customers used modified receivers to steal DISH programming. According to reports, EchoStar decided to pursue both cases after Garcia and the McSkimmings returned receivers to the company and it found them to be altered. The lawsuits claim the consumers also violated the Digital Millennium Copyright Act and the Communications Act of 1934. |
Silver Member Username: ThemangodPost Number: 346 Registered: Oct-06 | the paste above is old... all cool sat viewsat pansat have filed the same motion... all dismissed. but that means NOTHING pansat will not die. the thing is every one is in such a rush for what they want and they go any where to get that and those places that users go the most are a lot of them the ones named in the law suites. but they are so big that they just try to cover up the news.. notice other members here bashing what i say and they paste some of those same addresses because they are part of those sites and trying to cover it up, they know that most users wont read the court papers so if they keep saying its not true over and over again people will start to think they are right because they never seen the truth. thats why i say just look at the papers then call the court house ask if they have that suite on file. true i am spooking a lot of people and i am sorry for that but dish is going to take over those sites start selling units and do same thing DTV did bust the people that buy from those stores. we already know its happened in the past might as well be ready for the future. they got law suites in court now waiting... |

"With the Internet as a sword, pirates developed a new way to steal Dish Network programming by using so-called 'free-to-air' receivers," EchoStar said in a 19-page copyright suit filed earlier this month in U.S. District Court in the Southern District of California. Trying to clamp down on signal theft, EchoStar and NagraStar, which provides the direct-broadcast satellite provider's descrambling "smart cards," filed suit July 13 against set-top distributor ViewTech of Oceanside, Calif., and its founder and president, Jung Kwak. ViewTech distributes "free-to-air" set-top boxes, which can receive satellite signals that are either not scrambled or are scrambled but are available free of charge. This typically includes ethnic and religious programming. EchoStar charged in its lawsuit that distributors of free-to-air receivers have found a way to circumvent Dish Network's access-security system with those units by developing "firmware and components within each unit that will accept and receive illegal pirate software. ... Once this technology is downloaded or 'flashed' into the FTA receiver, the unit will illegally receive Dish Network programming." The suit also claims that in a new twist, pirates are now not only loading illegal pirate software onto FTA receivers so customers can get Dish service for free, but are also "distributing the requisite piracy technology and information to select individuals on Web sites or Internet discussion forums, who then offer the pirate software to consumers for download." Officials at ViewTech couldn't be reached for last week. But a lawyer who identified himself as counsel for the distributor posted a letter on the Web site EliteCoders (www.elitecoders.com ), claiming that the company and Kwak will "vigorously defend" themselves "against the baseless claims" made by EchoStar and NagraStar. "ViewTech and Mr. Kwak are confident that they will prevail as the lawsuit proceeds," attorney Manuel de la Cerra said in his letter on the Web site. Free-to-air pirates have distributed their illegal services and products to an estimated 2 million households in the United States and Canada, according to The Carmel Group, a California-based satellite industry consulting firm. |
