This suit should not worry any member of this community, nor should it worry about Viewtech or its products. Echostar is attacking the big guy on the block, that being viewtech. These type suits can take years to evolve into anything, if they even make it that far. Consider this a fishing expedition by Echostar into the halting of FTA receivers. As information is released by viewtech, inc and or the courts we will keep you informed. Rumor on the street is that this goes back to August 2006 (Maprom ECM) when Viewsat came up with the fix before any one else, they used Noth American coder to do their fix, sold the fix to others and were on top of the world, by using North American coder they left themselves open. More recently HashHU bust did not help them either, all this caught up to them and they are in deep trouble now. There are other individuals who are in big trouble also namely thedssguy and few others who suppose ably left high and dry to fend for themselves. |

(Which I hope it didn't include me, but if it did - Oh Well)... Most of us either Mod or Admin at our home sites. Which means, when something like this happens, our sites become very busy and that is where we do our work. That is our home site. We come in here to help when we can, but make no mistake about it, if we are busy, that's where we will be. As far as the ongoing issue with Viewtech and others. I'm not gonna get into Law 101, but fact is, if they had a strong case, they would go to Criminal Court and not Civil court. At this point they are just trying to slow the industry down. And making FTA receivers was not then and is not now Illegal. It is what is done to them afterwards that make them illegal. |

Reports are coming in that majority of the Viewsat official dealers are getting calls from Nagrastar (Echostar security division), they want to know how long these guys have been their dealers, how many units have been sold by them and what kind of support they have been receiving from Viewsat including the files. To make the matter even worse Viewtech CEO Jung Kwak along with others was found guilty of importing cable boxes to desclamber cable in the past and was fined by the court, that fine is still outstanding, it may not look good when he goes to court to defend Viewsat in North America |

The other counts will be bought up on real court charges by the city and state, not civil but criminal. you see they are suing them on counts that are all braking the law and they will be in real law issues if they lose. count v: Unfair Competition in Violation of California Business & Professions Code 17200 Calif law is setup so that they do not go after people for that unless there is civil case. there is no doubt they will get full dealers list that will happen with out a doubt. because that is how they can prove and say they are being unfair they must hand over those records. However that does not mean anything bad for the dealers that info by law could not be used unless there are future criminal action. there is a reason they went at Viewsat and the owner has been in this type of law issues before and that history will be able to be used in a Calif court. Viewsat owned had been in law issues for Cable Descramblers. If you live in LA you might recall about 6 years ago the cops busted some one and it was all over the local news, that was him. for the end users there is little to nothing to worry about other then maybe viewsat issues with there products and or company. But NO end users have anything more to fear. Every count they are suing on does not relate to a end user. Viewsat will lose on at least 1 count. some of the counts are based on each other if they viewsat beat one of them they beat 2. Dish will win atleast 1 count. what does this say for viewsat brand will you got to wait for the case to be over to know. if they lose will there be issues with viewsat receivers well there could be or there might not be all what counts they lose. I would just buy other brands till the lawsuit is cleared. Do not fear the law coming at you because thats not going to happen the very very worst for the end users they will have units with out future updates. But at this time that is just talk. viewsat lawyer does do this type of lawsuits so yes they did get a good persona and company to stand up for them. i hope this answers a few questions please ask more if you have any. |

To me, this Viewtech and Kwak entire thing is a frivilious lawsuit, that should/could bring punitive damages and sanctions against Nagravision and Echostar.....
